A: The NCCI filed a rate filing allowing for payroll exclusions for members of limited liability companies and partners who do not have any duties and do not visit the premises, except perhaps to attend directors’ meetings. The filings are for the construction industry only and will be effective June 1, 2009. So the “silent partner” will not be included in the premium calculation.

A: That partner is considered a “worker” and will be covered under the workers’ compensation law. The premium basis will be based upon the Schedule K-1.
